  • This case study highlights the misappropriation of a public natural resource. Public access to the backwaters of the Willamette River near Peoria, Oregon has been obstructed by the construction of berms along the river f or private benefits. Based on field measurements, existing studies, state laws and regulations; this paper analyzes the historical river course and land form changes, water and land ownership rights to ascertain the legality of the berm obstructions in the study area. This study concludes that the berm constructions are illegal. It outlines a checklist for concerned citizens to follow in cases of resource misappropriation. It urges public awareness and participation against violations impairing the use of a public natural resource.
