Abstract
  • The “why” of any situation is one of the most important questions to ask. Inventors have ideas every day. Some ideas are the brilliant ideas that lead to a better tomorrow. To protect these ideas, inventors turn to patents, a governmental grant of the right to stop others, for a limited time, from practicing inventions that are covered by the patent. The patent system is complicated and drains both time and money for this right. This thesis explores a number of key questions about the patent process. Why a patent owner would want to pursue or discontinue the application process or, if the patent has issued, the decision to “maintain” (pay maintenance fees) or to abandon the patent. This thesis will examine these questions by attempting to gain qualitative insights into the decision making process that influence why applicants would file an application and, later, choose not to pursue it (or not maintain the issued patent). After examining and reviewing a simplified version of the patent system, as well as performing an anonymous interview with 17 patent professionals, I have compiled explanations for why a person would want a patent, why a person would stop pursuing an application, and why after getting a patent a person would abandon it.
